This session will address the rapidly evolving liability risks that are emerging from the increasing use of electronic health information systems, the fact that they cannot be made absolutely secure, and that more than 50 million electronic health records have been breached in the past four years. Nearly every organization that uses electronic information systems has experienced at least one breach in the past two years and the federal and state governments and the public are demanding more accountability for breaches. The session will describe approaches to minimize those rapidly escalating liability risks.

- Identify liability risks from the useof electronic health information systems.
- Describe eff orts to shift liability to health care providers and practitioners.
- Discuss the ways to minimize the risk of liability from breaches of electronic health information.
